Data Protection Declaration

This data protection declaration explains how the Web Hosting Division of Verio Europe GmbH (hereinafter referred to as VERIO) collects and uses personal information about the users of its products and services.

WHAT PERSONAL INFORMATION DO WE COLLECT?

VERIO gathers, processes and uses personal information without explicit consent only as is necessary for the establishment and performance of the contract and for invoicing purposes.

For the establishment and performance of a contractual relationship we usually require the user’s name, postal address, telephone number, e-mail address, bank details and log-in details (known collectively as the inventory data). This data is usually gathered in electronic order forms.

WHAT DO WE USE YOUR PERSONAL DETAILS FOR?

VERIO uses this information for the following purposes:

- To provide and invoice products and services from VERIO and to send communications relating to your account and customer service enquiries.

- To check access rights to content.

- To monitor access to content, uploads and downloads for the purposes of calculating volume-based tariffs.

- User-specific special offers and product information.

Dissemination of personal details to third parties.

The user is advised that in order to register a domain it is necessary to communicate certain personal information, usually name and postal address, to the appropriate national and international registration bodies and to publish these details in the publicly available “Whois” databases. In order to register a .de domain, for example, currently you must send the name and postal address of the domain owner, the administrative and technical contact person and the zone administrator, as well as the telephone number, fax number and e-mail address of the technical contact person and zone administrator, to DENIC e.G., Frankfurt am Main. This information is published online in the DENIC database at www.denic.de. Usage data such as the start, end and scope of use of certain teleservices, or connection data in the case of e-mail services, are only gathered, processed and used as necessary to enable us to provide and invoice these services. As a general rule we record the date and time of the start and end of use, including the relevant time zone, the volume in bytes, the user’s IP address and the type of teleservice used.

VERIO will not use your personal details for any purpose other than those described here. In some cases it may be necessary to provide personal details to service providers contracted by VERIO in order to obtain access to certain content and products. Notification to this effect will be provided during the registration process, in the usage agreement, or by similar means. In such cases the personal details provided by you as part of the registration process for the product will be made available to the relevant VERIO partner. The partner company is bound to its data protection declaration with respect to the use of the information, and the use of VERIO products is bound to the present data protection declaration.

Please refer to the data protection declaration of the relevant partner to see how your personal details are used. If you do not agree to your information being shared in this way, you should not register for the service in question. Within the framework of content licensing and the payment of royalties, VERIO may also be obliged in some circumstances to provide special access and usage information to certain content providers and rights holders. In such cases, VERIO will provide the content provider with information about content usage and access, as well as demographic data and other data, but not personal information such as name, invoicing details or e-mail address.

From time to time we share relevant information about our customers with our contractual partners so that they can provide special services for VERIO. VERIO’s partners are obliged by strict contractual agreements to treat all the information they handle with strict confidentiality and only to use it on behalf of VERIO. VERIO websites and products may contain links to other websites and products. However, VERIO is not responsible for the data protection practices or content of these websites or products. Please refer to the data protection declarations of these third-party providers on their respective websites for information on how they collect and protect your data.

E-MAIL FROM VERIO

When you register for a product or service you can specify whether you wish to receive VERIO’s newsletter, which is sent out at irregular intervals, about products, content and special offers. You can unsubscribe from these e-mails at any time by clicking on the link at the bottom of the newsletter. It is possible that we will continue to send you e-mails about products you have bought in the past (e.g. free product updates), as well as information about your account status or important technical services for a VERIO product or service.

ACCESS TO PERSONAL DETAILS AND UPDATING YOUR DETAILS

To access your account and update your account information, go to the administration pages for your account (Control Panel, e.g. www.your-domainname.de/stats/). On the log-in page, enter your user name and password (log-in details) to access your account information.

If required, you can modify your account details in the “Administration” area.

If you forget your password, please contact our support team, quoting your user ID or domain name.

SECURITY OF PAYMENT INFORMATION AND PERSONAL DATA

VERIO employs monitoring measures to protect the information you provide when you place orders, including credit card and invoicing details:

- The use of secure connections such as SSL to securely encrypt data during transfer from the customer’s web browser to VERIO.

- Security checks that limit access to the databases in which personal details are stored.

- Encryption of confidential data, such as credit card numbers and user names.

- We never store credit card details on our servers.

- Limitation of employee access to personal details and confidentiality regulations for employees.

- Subcontractors obliged by technical and organisational articles of contracts to protect personal details.

USE OF COOKIES

Like other major service providers we use cookies in order to tailor your customer experience on our websites and the use of our products to your individual needs. We also use cookies to help us understand traffic patterns on VERIO websites and to authorise access to certain content and product features. We treat all personal details contained in cookies with the same level of confidentiality as all other information you provide.

VERIO does not require you to accept cookies. However, some features of our websites, the product ordering process and products or services may be impaired if cookies are blocked.

You can configure your web browser so that you are notified whenever a cookie is received and you can choose to enable or block the cookie.

CHANGES TO OUR DATA PROTECTION DECLARATION

We revise our website data protection declaration on a regular basis. To keep users informed of recent changes and the date of the most recent version, the page is labelled as a new version (“updated”).

NO ERROR-FREE SERVICE

We do not normally publish alpha and beta versions of our products. However, since it is possible that product defects may arise in spite of careful checking, we may not be able to avert unforeseen data protection problems. We therefore welcome feedback on any issues relating to data protection and the improvement of our products. In this data protection declaration, VERIO offers no guarantee of error-free service. VERIO makes all reasonable effort to comply with this data protection declaration. In the event of an infringement of the data protection declaration which comes to our attention, we will take appropriate action immediately. VERIO accepts no liability for any secondary or subsequent damages or claims for damages relating to this data protection declaration. This data protection regulation is subject to the laws of the Federal Republic of Germany and EU ordinances and directives.

VERIO may divulge personal information if required to do so by law or if VERIO believes in all good faith that this step is necessary in order

(a) to comply with certain laws or legal requirements to which VERIO is subject; (b) to defend the rights or property of VERIO and its products; or (c) in exigent circumstances, to take action to protect the personal safety of users of the company’s products or the general public.
